Welcome to Foggy! These Terms of Service ("Terms") govern your use of the Foggy application and related services (collectively, the "Service") operated by Foggy LLC ("we," "our," or "us").

By accessing or using Foggy, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Account Registration

To use Foggy, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

2. Service Description

Foggy is a task management application designed to help people with ADHD and executive dysfunction organize their tasks. The Service includes:

• Free Tier: Limited to 5 tasks per day, basic Pomodoro timer, single device
• Foggy+ (Paid): Unlimited tasks, cross-device sync, all features

We reserve the right to modify, suspend, or discontinue features with reasonable notice.

3. Subscriptions and Payments

Pricing

Foggy+ is available for $5 USD per month. Prices may change with 30 days notice to existing subscribers.

Billing

• Subscriptions are billed monthly in advance
• Payment is processed securely through Stripe
• Your subscription renews automatically unless cancelled

Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• No refunds for partial months

Refunds

We offer refunds within 7 days of your first payment if you're unsatisfied. Contact legal@foggytask.com for refund requests.

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Scrape, crawl, or use automated means to access the Service
• Impersonate others or misrepresent your affiliation
• Use the Service to harass, abuse, or harm others
• Circumvent usage limits or payment requirements

5. Your Content

Ownership

You retain ownership of all content you create in Foggy (tasks, projects, notes). We do not claim any intellectual property rights over your content.

License to Us

By using the Service, you grant us a limited license to store, display, and transmit your content solely to provide the Service to you.

Responsibility

You are responsible for the content you create. Do not store sensitive information like passwords, financial data, or confidential business information in task descriptions.

6. Intellectual Property

The Foggy application, including its design, code, features, and branding, is owned by Foggy LLC. You may not:

• Copy, modify, or distribute our software
• Reverse engineer or decompile the application
• Use our trademarks without permission
• Create derivative works based on our Service

7. Privacy

Your use of Foggy is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of your data against all threats

Foggy is a productivity tool, not medical advice. We make no claims about treating ADHD or any medical condition.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss, even if we were advised of the possibility

Some jurisdictions do not allow limitation of liability, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Foggy LLC from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

By You

You may delete your account at any time through the app settings or by contacting us.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Abuse the Service or other users

We will provide notice before termination unless immediate action is necessary for security.

Effect of Termination

Upon termination, your right to use the Service ceases. We may delete your data after 30 days.

12. Dispute Resolution

Informal Resolution

Before filing any claim, you agree to contact us at legal@foggytask.com to attempt informal resolution.

Arbitration

Any disputes that cannot be resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association. You waive the right to participate in class actions.

Exceptions

Either party may seek injunctive relief in court for intellectual property violations or security threats.

13. General Provisions

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Foggy LLC.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right does not waive that right.

Assignment

You may not assign these Terms. We may assign our rights in connection with a merger, acquisition, or sale of assets.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms.
